The Himalayan Initiatives (THI) Terms and Conditions
Please note, while these Terms & Conditions apply to both students, non-students who use the services of The Himalayan Initiatives, some specific terms and conditions apply only to those who paid fees, and some apply only to those who do not need to pay any fee – these are clearly marked below.
- The purpose of these Terms & Conditions is to set out the contractual basis for your relationship with The Himalayan Initiatives (THI) and to draw your attention to key terms.
- Your contract with THI is made up of these Terms & Conditions.
- You will enter into your contract with THI when you submit your application.
- You will enter into this contract with THI even if your application was submitted by a third party on your behalf or by email.
- Your application is conditional upon you providing true, genuine, accurate and complete (i.e. not omitting information you have been asked to provide) information in your application form and on you meeting any conditions of your offer.
Eligibility
- THI’s services are open to individuals from the Himalayan Regions (China, Tibet, Bhutan, Nepal, Bangladesh, India, Pakistan) and internationally (in exceptional cases). You must be at least 18 years old at the start of the application. There are no upper age limits for using THI’s services.
- THI’s online consultation is free and open to all individuals aged 18 years. There are no upper age limits for this service.
Eligibility for free service
- An individual from the Himalayan Regions (China, Tibet, Bhutan, Nepal, Bangladesh, India, Pakistan) and internationally (in exceptional cases).
- From disadvantaged background which we need to check and verify (specific conditions will apply in case to case).
- Be able to demonstrate one’s potentiality to achieve a good result if an opportunity is granted.
Pay fee at end of the application service
- If you are eligible to pay the fee at the end of the application process, then below terms and conditions of fee payment, cancellations and refund do not apply to you.
- You will be informed by THI if you are eligible for this category of paying the fee at the end of your application service.
Fees and Payment
- If you are eligible to the free service of THI, then, the below terms and conditions do not apply to you.
- If the chosen service is not free, you have to pay the service fee. Our staff will explain the details of the fees and charges you will have to pay.
- You (or a third-party paying fee on your behalf) may pay your fees and other charges:

- through PayPal, as instructed upon receiving confirmation of your successful application. In this case, your fees will be received, and your enrolment accepted when the cleared funds enter THI’s PayPal account.
- through bank transfer, as instructed upon receiving confirmation of your successful application. In this case, your fees will be received and your enrolment accepted when the cleared funds enter THI’s bank account.
- It is your responsibility to ensure that the course fees are paid by the deadline notified. You are responsible for any non-payment even if your fees are being paid by a third party.
- THI reserves the right to refuse your application if you have not paid all compulsory fees before the application work.
- All payments must be in GB Pounds Sterling. You must pay any currency conversion costs or other charges incurred in making the payment or in processing a refund.
Cancellations and refunds – within 14 days
- You have the right to cancel your contract at any time within 14 days of its commencement. You will receive a full refund of any payments you have made.
- If you cancel your place on a course at any time after the expiry of the 14 day period you will not be entitled to a refund, except in exceptional circumstances, at the discretion of THI. If a refund is made an administration fee may be charged.
- To cancel within 14 days please inform us in writing by email (admin@himalayaninitiatives.org). Please write the name of your application in the subject-line of your email.
Cancellation by us
- Where there are good reasons to do so THI may cancel your application by giving you notice in writing at any time before the application work. THI will refund all fees paid by you.
- THI’s liability when it cancels a part of your application work will be limited to a refund of any fees paid for the cancelled application. For partial cancellation of an application, such refunds will be made on a proportionate basis.
Personal Data
- THI will collect and use information about you in accordance with the principles set out in our Privacy Policy at This includes ensuring that your data will only be used in a way that is fair, lawful and secure.
- THI staff members may ask you to participate in photographs, videos or other promotional activities during the application process, for use in THI’s future publicity. You should advise THI in writing before the application if you would prefer not to participate in these activities and unless otherwise instructed in writing, THI may use these images for its business use and promotional activities on an ongoing basis
The Equality Act
- If you identify as disabled or have any other particular requirements you are asked to provide THI with sufficient information in writing by email (admin@himalayaninitiatives.org) so that THI can start to consider and make any reasonable arrangements.
Complaints Procedure
- If you have a complaint, you should inform us in writing by email (admin@himalayaninitiatives.org). We will endeavour to respond as soon as possible.
Termination
- Your contract with THI will end in the following circumstances:

- when you finish your application work or if you cancel or withdraw from your application services and so cease to be a current applicant.
- if THI exercises its right to cancel or discontinue your application under paragraphs 18 above;
- if you fail to comply with paragraph 5 above.
- The following terms will survive termination of your contract with THI for any reason:

- terms relating to personal data as described in paragraph 26 and 27 above; and
- terms relating to THI procedures to the extent that they relate to events that occurred prior to termination including the complaints procedure.
You agree to:

- behave considerably, responsibly and co-operatively towards anyone involved with THI, including fellow students, educational experts, and staff.
- not make use of the name, logos, trademarks, or materials of THI without written permission.
- not publish any material by any medium relating to THI, its staff, students, or any other person or body THI has a relationship with without THI’s written permission.
Jurisdiction
- Your contract with THI and any dispute arising from it (including non-contractual disputes) shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.
